Designation of Sudbury Town Residents’ Association as a Neighbourhood Forum

The Council has published Sudbury Town Residents’ Association application for Neighbourhood Forum status. Consultation will be from a 6-week period starting from 12th January 2023 until midnight 23rd February 2023.

The Neighbourhood Planning (General) Regulations 2012 (as amended) set out what is required when an organisation submits a neighbourhood forum application to the local planning authority. It must include:

a)         the name of the proposed neighbourhood forum,

b)         a copy of the written constitution of the proposed neighbourhood forum,

c)         the name of the neighbourhood area to which the application relates and a map which identifies the area,

d)         the contact details of at least one member of the proposed neighbourhood forum to be made public, and

e)         a statement which explains how the proposed neighbourhood forum meets the conditions contained in section 61F(5) of the Town and Country Planning Act 1990 (as amended).

In relation to e) the following are the most relevant aspects of Section 61F(5) of the Act are: 

f)           it is established for the express purpose of promoting or improving the social, economic and environmental well-being of an area that consists of or includes the neighbourhood area concerned (whether or not it is also established for the express purpose of promoting the carrying on of trades, professions or other businesses in such an area),

g)         its membership is open to—

(i)     individuals who live in the neighbourhood area concerned,

(ii)    individuals who work there (whether for businesses carried on there or otherwise), and

(iii)  individuals who are elected members of a county council, district council or London borough council any of whose area falls within the neighbourhood area concerned,

h)         its membership includes a minimum of 21 individuals each of whom—

(i)     lives in the neighbourhood area concerned,

(ii)    works there (whether for a business carried on there or otherwise), or

(iii)  is an elected member of a county council, district council or London borough council any of whose area falls within the neighbourhood area concerned.

The Council is seeking views on whether the application submitted is consistent with the statutory requirements and forum status should be approved. If granted, the forum status would apply for 5 years. In that time no other organisation or body may be designated for that neighbourhood area until that designation expires or is withdrawn. When reporting the consultation responses, organisation names will be referenced by the Council. However, no individual’s name or personal details of respondents will be made publicly available. Please can you indicate with your response whether you wish to be informed by the Council of whether the forum status is approved. Please also indicate if you would like to be informed of other planning policy consultations by having your details put on our planning policy consultation database. This information will only be used in relation to consultations on the Council’s planning and associated documents. Unless you indicate that you want to be put on this database, your personal details will only be kept until the Council makes a decision on whether to proceed with the approval of the forum or not and has subsequently issued the appropriate notifications.
