Public Space Protection Order for Nuisance Vehicles

On 1st April 2023 the Council made a decision to introduce a Public Space Protection Order for Nuisance Vehicles. The Public Space Protection Order was in effect from the 20th April 2023 for a period of 2 years. 

The existing PSPO prohibits the following activities:

(A) Revving of Engine(s) as to cause a public nuisance

(B) Repeated Sudden and rapid acceleration (as a public nuisance),

(C) Racing

(D) Performing stunts (as to cause a public nuisance

 (E) Without lawful authority or reasonable excuse wilfully causing obstruction on a public highway, whether moving or stationary, including driving in a convoy

 (F) Vehicles driving over Footways, Footpaths and Verges without reasonable or lawful excuse (Illegal Crossovers)

Breaching the terms of the PSPO without reasonable excuse is a criminal offence. This means either a Fixed Penalty Notice can be issued or prosecution can commence and if found guilty may be liable to summary conviction by a level 3 fine.

Under section 60 (2) of the Anti-social Behaviour, Crime & Policing Act 2014, the Council now wishes to apply for an extension of the period of time the Order is in effect before it expires. Under section 72 (1) and (3) of the Anti-Social Behaviour Crime and Policing Act 2014, the law requires the Council to carry out the necessary publication and public consultation to obtain your views of the proposal to extend the existing PSPO before a final decision is made to do so.

The Proposal

The extension of the PSPO is proposed to continue on the same terms and Prohibitions as contained within the existing Order as referred to above. 

The boroughwide PSPO for Nuisance Vehicle will continue to be defined as set out in the proposed PSPO Plan below

The restrictions which are proposed to continue are:

 (A) Revving of Engine(s) as to cause a public nuisance

(B) Repeated Sudden and rapid acceleration (as a public nuisance),

 (C) Racing

(D) Performing stunts (as to cause a public nuisance)

(E) Without lawful authority or reasonable excuse wilfully causing obstruction on a public highway, whether moving or stationary, including driving in a convoy

(F) Vehicles driving over Footways, Footpaths and Verges without reasonable or lawful excuse (Illegal Crossovers)

Why your views matter

Since the existing PSPO has been in place, the Council have noticed and actioned

·      approximately 400 vehicles have attended the car meets over this period to either drift or to spectate. 

·      2 ANPR CCTV cameras have been deployed in 2 locations to capture this nuisance behaviour.

·      The drivers causing a nuisance were issued FPN’s as well as CPW’s and Section 59’s from the police, while spectators that turn up and got captured on CCTV were also issued CPW’s and Sec 59’s for attending the organised events. 

·      Long-term deterrents were implemented such as anti-skid markings on the road. 

The Council considers it is reasonable to extend the existing PSPO for Nuisance Vehicles and the Order can last for a further period of up to three years which will be an effective way of dealing with the problem. The Council can also enforce any breach of the PSPO through Fixed Penalty Notice or by issuing a Summons in the Magistrates Court.
